DEVELOPMENT OF THE NATIONAL QUALIFICATIONS SYSTEM IN UKRAINE: REGULATED PROFESSIONS IN THE CONTEXT OF EUROPEAN APPROACHES

Abstract. The article examines the possibility of introducing regulation of certain professions in Ukraine within the framework of the National Qualifications System, in compliance with the legislation of the European Union and the practice of EU member states. It is shown that in Ukraine there is no regulation of professions in the sense of EU legislation. At the same time, the legislation on the National Qualifications System allows almost all legal entities to participate in the development and approval of professional standards. This creates risks for the functioning of professions that are critical for human health and life, public safety, etc. Two possible approaches to the regulation of individual professions are considered: 1) a parallel approach if the legal regulation of the National Qualifications System does not apply to regulated professions, and 2) the integration of regulated professions into the National Qualifications System. The possibility and feasibility of applying the second approach are substantiated. The article analyses studies on the impact of professional regulation on economic development in EU countries. Based on this, an approach is developed to introduce a criteria-based method for granting the status of “regulated” to a profession in order to comply with the principle of proportionality outlined in EU legislation. The article proposes to distinguish between two categories of regulated professions with different levels of regulation: 1) professions that are important for preserving health and life, public safety, etc., and 2) professions that are regulated for other reasons and purposes. A draft law on regulated professions has been developed. For such professions, it is proposed that independent expert assessments of professional standards be carried out by recognised professional associations before their approval. It is also proposed that the accreditation of qualification centres for professions (professional qualifications) be carried out with the involvement of recognised professional associations. Such associations should have the right to initiate changes to professional standards regardless of the position of the standard developer. Thus, it is possible to create a unified qualifications system in Ukraine – both regulated and unregulated, harmonised with EU legislation.
