DECENTRALISATION REFORM IN TERMS OF TRANSFERRING THE PROPERTY OF VOCATIONAL EDUCATION AND TRAINING INSTITUTIONS TO THE MANAGEMENT OF LOCAL AUTHORITIES

Abstract. The article deals with the decentralisation reform of administrative authorities in Ukraine. The study analyses the legal framework for the implementation of the decentralisation reform, the processes of management transfer from central to local authorities and the mechanisms for ensuring quality of vocational education and training (VET). The importance of the transfer of state-owned real estate of VET institutions from state to communal ownership is substantiated, as this will enable local authorities to fulfil the tasks set by the decentralisation reform, in particular to provide quality vocational education and prepare workers to meet the demands of the local labour market. An analysis of data from the automated system “Legal Entities” on the transfer of VET institutions and their integral property complexes from the operational management of the Ministry of Education and Science of Ukraine to regional budgets, budgets of city territorial communities based in regional centres and the budget of Kyiv is conducted. It was noted that between 2017 and 2024, the Cabinet of Ministers of Ukraine adopted a number of decisions to transfer 217 VET institutions and their property to the operational management of local authorities. However, as of 1 September 2024, according to the automated system “Legal Entities”, only 52 such institutions have been transferred. The factors reducing the effectiveness of government decisions are outlined, including the full-scale war launched by the russian federation against Ukraine, delays in updating data on state real estate of VET institutions in the “Legal Entities” system, insufficient funding for the registration of ownership rights to state real estate, and the reluctance of local authorities to take over the management of VET institutions. Further research is planned on the transfer of VET institutions to communal ownership, with an expanded focus on pre-higher professional education institutions, which have begun to be transferred to communal ownership during the current year.
