APPROACHES TO COLLECTIVE-CONTRACTUAL REGULATION OF SOCIAL AND LABOR RELATIONS IN UNIVERSITIES AS AUTONOMOUS INSTITUTIONS OF THE NON-FINANCIAL CORPORATE SECTOR
Abstract. The article analyzes the state of regulation of social and labor relations between employees and the administration of domestic higher education institutions. It is determined that regulation of social and labor relations of employees of higher education institutions, as well as other employees in the budget sphere, includes coordination of issues regarding conditions, regimes, payment, norms, organization of labor, parameters and sizes of social protection, vacations and conditions of professional growth, etc. Today, there are not any non-profit institutions – universities in Ukraine, that is why research in this area has been actively pursued only in recent years. The author’s study of the above question allows us to draw the following general conclusions: the most effective tool for reforming Ukraine’s higher education is to create conditions for the gradual change of the status of a higher education institution from a budget institution to a non-profit institution; this transition requires the support of the state, first of all, with regard to the deregulation of issues in the legislative, regulatory, institutional, financial, material, social and labor and personnel support of higher education institutions of the new formation; the instrument for regulating social and labor relations between employees and the administration of non-profit universities is solely to regulate most of the issues on the basis of the financial results of the higher education institutions as an autonomous institution of the non-financial corporate sector. Based on the author’s preliminary study of the foreign experience in regulating the admission, dismissal, professional growth, conditions and remuneration of university workers, specific suggestions are made to expand the autonomy of Ukrainian higher education institutions through collective agreement, the establishment of sectoral qualifications frameworks and tariff upgrades in higher education nomenclature, etc.
